Subscriber Agreement

This Agreement applies to a Subscriber's use of the Midwest Child & Family Institute's (MC&FI) California Child & Family Law Regulatory Reporting Database. By using the database, the Subscriber agrees to comply with the terms and conditions of the Subscriber Agreement. If Subscriber does not accept any of the terms of the Subscriber Agreement, s(he) should not use the MC&FI Web Site. MC&FI may, at its discretion, change the Subscriber Agreement at any time. By continuing to use MC&FI after a modification to the Subscriber Agreement, Subscriber agrees to be bound by the modifications to the Subscriber Agreement.

 1. MC&FIís Rights and Responsibilities

 1.1. MC&FI reserves the right to change any information on its Web Site at any time. This right includes MC&FIís right to revise or delete features or other information, without prior notice. 

1.2. Clicking on certain links within the Web Site may take Subscriber to other web sites out of MC&FIís control, and MC&FI assumes no responsibility for the content and availability of such sites. These links are provided as a convenience to Subscriber.

1.3. MC&FI reserves the right to refuse to allow access to its Web Site to any Subscriber violating the terms of this Subscriber Agreement, or any law or regulation. MC&FI may take any reasonable actions necessary to protect itself or its Subscribers.

1.4. MC&FI reserves the right to seek all remedies available at law and in equity for violations of this Subscriber Agreement, including the right to block access from a particular Internet address to the Web Site.

2. Warranties/Limitation of Liability 

2.1. MATERIALS AVAILABLE IN THIS SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.

2.2. The reports available on the Web site are intended as a convenience to Subscriber, and by their nature do not constitute legal advice. Thus, it is the Subscriber's responsibility to confer with his/her/its legal counsel, when necessary.

3. Trademarks and Copyrights

3.1. Information supplied to Subscriber by MC&FI is protected by copyright, all rights reserved, and not for resale or redistribution. This restriction is not intended to preclude sharing information within Subscriberís organization with employees and affiliated companies as outlined in Subscriberís contract. Excerpts may be republished with attribution and proper copyright and trademark notice. 

3.2. Subscriber agrees that the username and password supplied by MC&FI shall be for Subscriberís use only and shall not be provided to any other person, firm, corporation or association. It is Subscriberís responsibility to maintain the confidentiality of Subscriberís username and password. Otherwise, Subscriber shall be fully liable for any unauthorized use of Subscriberís username and password. 

4. Additional Terms 

4.1. MC&FIís Privacy Policy is incorporated by reference here.

5. General Provisions 

5.1. The laws of the State of Illinois shall govern the Subscriber Agreement, and the relationship between the parties. Subscriber and MC&FI agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Illinois.

5.2. MC&FI may amend this Subscriber Agreement at any time by posting the amended terms on the Web Site. This Subscriber Agreement may not be otherwise amended except in a writing signed by MC&FI and Subscriber. 

5.3. MC&FIís failure to exercise or enforce any right or provision of the Subscriber Agreement shall not constitute a waiver of such right or provision. 

5.4. If any provision of the Subscriber Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the partiesí intentions as reflected in the provision, and the other provisions of the Subscriber Agreement shall remain in full force and effect.
